Winning Your Malpractice Case: Practical Advice for Physician Experts and Defendants
James J. Cicero, MD, FACEP

Softbound Book
ISBN 1578397235
HCPro / Opus Communications
December 2005

Prepare and protect yourself with valuable advice from an experienced physician-expert.

Concise and enjoyable to read, this helpful resource book will give physicians the knowledge and confidence to successfully defend their professional opinions - and themselves - in the legal setting.

Whether you're a physician yourself, or a risk manager searching for resources to help prepare your doctors for the legal setting, Winning Your Malpractice Case will be a helpful resource for you. A realistic, real-world explanation of what to expect throughout the legal system, this book provides an overview and an orientation to the legal process, and presents the information physicians need to protect themselves in the legal setting, including:

  • How to prepare for a case
  • What to do before giving a deposition
  • How to conduct yourself throughout the legal process
  • How to be effective on the witness stand

This book also provides valuable real-life examples of good and bad witnesses so that readers have a clear understanding of what they can expect in the courtroom. The number of malpractice lawsuits continues to grow exponentially. Today, more than ever, physicians have to be their own best advocates throughout the legal process, from deposition to trial. After all, a bumbled deposition or court appearance can compromise a physician's reputation. Medical expertise and legal savvy don't always go hand in hand, and the legal system can be an intimidating environment for physicians. This book will make sure you are prepared before you are subpoenaed, asked to give your deposition or before you walk into the courtroom.

Author James J. Cicero, MD, FACEP, a retired emergency medicine doctor with extensive experience as a medical expert, shares his legal expertise in a first-person, conversational style. Dr. Cicero retired in 1995 as chief of the emergency medicine department at Regions Hospital in St. Paul, MN, which was the trauma center for eastern Minnesota and western Wisconsin. He has worked as an expert witness on 97 malpractice cases and screened cases for a busy plaintiff law firm that handles many malpractice lawsuits. Dr. Cicero joined the emergency medicine department at Regions Hospital, which was then called St. Paul Ramsey Medical Center, in 1974. He was chief of emergency medicine from 1982 until he retired. While serving as chief, Dr. Cicero led the development of a captive insurance program for a 200-physician clinic and served as its president. In this role, he helped to evaluate each malpractice case brought against members of his clinic to decide all the issues about the case. This, combined with Dr. Cicero's medical expertise and extensive experience as an expert witness, has given him unique insight into the legal process as an expert or a defendant.
